  • The Coronavirus Aid, Relief, and Economic Security (CARES) Act signed into law March 27 eliminated the federal rules protecting the confidentiality of substance use disorder (SUD) treatment records Those rules, codified under 42 CFR Part 2 of the federal regulations, are going to be changed In an overview of the CARES Act amendments regarding confidentiality released by the Legal Action Center (LAC) in April, the law firm pointed out that the amendments don\'t take effect until March 27, 2021 Between now and then, the new regulations will be crafted And that overview also includes recommendations for how the language of the new rule could mitigate against the damages expected when patients learn that their treatment may not be confidential
